Contest Rules, Terms and Conditions

1. Introduction

Diamond Bakery, as its roots planted in the island, has dedicated itself in caring and preserving Hawaii’s Coral Reef System for the benefit of present and future generations. As part of its understanding efforts, Diamond Bakery has teamed up with Atlantis Adventures and developed a Reef Conservation Campaign - Saving Kimo. The purpose of this program is to provide DB and its partners the opportunity to promote reef conservation through community and corporate partnership, and at the same time help individuals, especially young generations, better understand and ultimately conserve our island Reefs.

2. How to Enter

You can enter online or by mail during the contest period (1AM, HT, July 28, 2008 through 11:59:59 PM, September 30, 2008). Each entry must contain an essay of 250 words or more describing conservation awareness, environment protection, “Do not be a litter bug”, and importance of keeping the reef clean and undisturbed. All the entries must be submitted by September 30, 2008 and will be judged. You may include color photographs (JPG, GIF, or PDF) or a video (MPG or QuickTime) showing how you help Kimo and his friends save Hawaii’s Coral Reef System. The essays and photographs/videos are collectively designated herein as “Entries”. All Entries must (1) be original and (2) not infringe the intellectual property rights of any third party.

(a) Online Entry: Log onto www.diamondbakery.com, follow the instructions and complete the Entry online.

(b) Entry by Email: Send your Entry to info@diamondbakery.com.

(c) Entry by U.S. Mail: Mail your Entry to 756 Moowaa St., Honolulu, HI 96817. Clearly print or type your entry and include your name, address, phone number and e-mail address.

3. Eligibility

All online Entries must be received by 11:59 p.m. HT, September 30, 2008. Winners will be contacted and announced on October 15, 2008. All Mail Entries must be post marked no later than October 5, 2008. Only one Entry per person will be accepted regardless of entry method.

Entrants may be asked to consent to receive promotional e-mails and reminder e-mails from Diamond Bakery. Such consent is not a condition of eligibility and does not improve an Entrant’s chances of winning. Such e-mails would be subject to the privacy policy of Diamond Bakery and Entrants may opt out of receiving them at any time. Contest is only open to persons (1) who are legal residents of, and physically located within and eligible to work in, the 50 United States or the District of Columbia, (2) are not employees of Diamond Bakery, or their households or immediate families. In addition, Entities are not responsible in any way for Entries that are altered, delayed, deleted, destroyed, fraudulent, illegible, improperly accessed, inaccurate, incomplete, interrupted, late, lost, misrouted, multiple, mutilated, non-delivered, postage-due, stolen, tampered with, unauthorized or unintelligible; or any printing, production, technical, electronic or other errors; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in Entrant’s email account to receive email; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of any of the Entities or each of such potential Entries will be disqualified. Challenge is void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.

4. Procedure/Judging:

Each entry must be about conservation awareness, environment protection, “Do not be a litter bug”, and importance of keeping the reef clean and undisturbed. Submitted entries will be judged based upon uniqueness/creativity, local appeal, and adherence to contest theme and the company’s mission of sharing heartwarming aloha with the world. Decisions of the judges are final.

5. Prize: One (1) Grand Prize:

— The contest is open to three age groups with different criteria:

— Kindergartens – 5th grade: a color drawing

— 6th - 8th grade: a color photograph or an essay

— 9th grade and above: a 2-minute video

— The contest offers 6 awards in three different categories. The winners in each category will appear on KSSK on the Perry & Price Show at John Dominis and all the winners will be announced on ISLAND 98.5 on Lanai’s Morning Madness. They will also receive

The Winner will be notified by overnight delivery service on or about October 30, 2008. Disqualification and the selection of an alternate Winner may result from the Winner’s failure to respond to notice within five (5) business days from the date of transmission. By submitting your memory story you grant us permission to publish your name and story for editorial and promotional purposes, except where prohibited by law; and without compensation.  We reserve the right to edit the story.  Entries will not be returned. All copyright rights of winning stories will belong to Diamond Bakery Co., Ltd.  Diamond Bakery assumes no responsibilities for entries that are unable to be accepted due to illegibility, lost or delayed mail or due to phone, electronic, network or computer failures of any kind.  Subject to all US Federal, state and local laws and regulations.  Void where prohibited.  Taxes on prizes are the responsibility of the winners.
